Terms & Conditions

The following terms and conditions apply to all products on our website that are distributed by Flanagan Flooring Distributors.

The following are extracted from the Standard Terms & Conditions of Sale of K.J. Flanagan & Co. Ltd, Flanagan Flooring Distributors
(Scotland) Ltd & Flanagan Flooring Distributors (Ireland) Ltd.

1. PRICES

We reserve the right to alter prices without prior notice. Placing of an order implies acceptance of these terms and conditions.

2. PLACING OF AN ORDER

We reserve the right to accept or refuse any order. Placing of an offer implies acceptance of these trading terms and conditions.

3. DELIVERY

All goods must be examined at the time of delivery. Claims for damages will be accepted only if Flanagan Flooring Distributors is given notification within three days of delivery. Risk of damage or loss of goods shall pass to the buyer on delivery. Where the goods are damaged in transit the carriers note should be endorsed accordingly and the Company notified in writing within 7 days.

4. DATE OF DELIVERY

Information given on date or time of delivery is given in good faith. However the Company cannot accept responsibility for any delays in delivery.

5. CANCELLATIONS

A cancellation will only be accepted when it will not cause loss or cost to this Company. No cancellations will be accepted after the floor coverings have been cut to size. All cancellations must be confirmed in writing.

6. TITLE TO GOODS

Flanagan Flooring Distributors shall retain ownership of all goods supplied until the customer has made payment, in full, for the goods. Until such payment, the goods shall be properly stored and maintained in good condition and shall at all times be separately stored in such a way as to be identifiable by the vendor, immediately return or release the goods to Flanagan Flooring Distributors.

7. RETURN OF GOODS

(a) The return of goods must be made within fourteen days from the date of purchase.
(b) All goods for return must be in unopened packaging.
(c) All up lifts have to be confirmed by phone with our office, detailing all relevant information, as drivers are not authorised to up lift goods without approval. 20% handling charge for boxes & 30% handling for cuts 4m in length and above. Anything under 4m length will not be accepted.

8. COMPLAINTS

Credits will only be given within 7 days of delivery of goods and we cannot accept complaints regarding colour, pattern matching, piling or flattening, soiling, fading, staining or short measures when goods have been cut or fitted. We will not accept any responsibility for shrinkage of carpets which have not been secured to the floor. All complaints must be notified in writing on Company complaint forms and on no account should payment of these goods be held against outstanding credits. Claims for manufacturing faults will not be accepted after goods have been cut. Carpets should, therefore, be inspected prior to fitting.

9. MANUFACTURERS LIABILITY

The Company’s liability for defective goods will be limited to replacement with equivalent value or with a credit note to that value, and no claims can be accepted for any other loss or damage either direct or consequential suffered by the purchaser or their customer. No claims will be accepted in respect of any shortages which are within the normal manufacturing tolerances of 1.25% in respect of length and width. Liability will in all cases be limited to the value of goods supplied. Claims for lost time / fitters time or other consequential losses will not be accepted.
